In November 2012 Kirby Kearns (@Resoguy) of Resolution Productions (equipment hire, tv and video
production company based in Doha, Qatar) instigated libel proceedings against me because I complained
publicly on Twitter that he had delayed paying my invoice (see initial tweet). These proceedings were stressful
and time-consuming. As Mr Kearns is resident in Qatar, my solicitors applied for an order requiring Mr Kearns to pay
money into court as security for my costs of defending the claim. Despite his solicitors (@LibelSolicitor) threatening
me with indemnity costs orders for making this application and saying it was unfounded (but never explaining why),
Mr Kearns on 18 November 2013 decided to 'discontinue the claim' 2 weeks from when my application was going
to be heard. Mr Kearns explains this decision as being based on being unwilling to pay security for my costs.
What this means is that AFTER INTENSE AND UNPLEASANT PRESSURE from Mr Barjinder Sahota
of Sahota Solicitors, acting on behalf of Kirby Kearns, I stood my ground and the case has been
dropped rather than have Mr Sahota explain Mr Kearns's arguments to a Judge.
There were many people who supported me on the long road to justice. I am eternally grateful to
Simon Singh for referring me to Robert Dougans of Bryan Cave, together with Jonathan Price of
Ely Place Chambers who defended me on a no win no fee basis. Special thanks too to the
Libel Reform Campaign who set up a fund to help pay initial legal costs. Lastly, I will never be able
to adequately express my gratitude to all the amazing and kind folk who contributed to the fund.
Without that payment there is a good chance I could have been prevented from defending this claim.
I know there are other people out there who are representing themselves in libel claims.
My thoughts go out to you all. I know the stress you face. Do please get in touch with me
and share what is happening and we can try and help you.
On a personal note, my heartfelt love and devotion for my husband Kevin who has stood by me,
loved me and given me the strength to carry on at those lowest moments when I was ready
to end it all.
On 4 and 5 December 2013 there was a hearing to decide whether Kirby Kearns, Managing Director
of Resolution Productions, (an equipment hire, tv and video production company based in Doha, Qatar),
should be liable for my costs on an indemnity or standard basis.
My lawyers relied upon the conduct of the action by Mr Kearns's solicitor, Barjinder Sahota of Sahota
Solicitors, in arguing that Mr Kearns's conduct went so far outside what was reasonable that Mr Kearns
ought to pay my costs on the indemnity basis. Mr Kearns argued his conduct was not outside what
was reasonable and also argued that he should not be held responsible for any unreasonable
conduct by his solicitor.
Mr Justice Nicol ordered Mr Kearns to pay standard costs to 10 May 2013, the date on which
my solicitors offered to settle, demanded security for my costs of defending the claim and ordered
Mr Kearns to pay indemnity costs after that date. The judge described some of the behaviour
of Mr Kearns's solicitor, Barjinder Sahota, as lacking proportion and Mr Kearns was ordered by
Mr Justice Nicol to pay on account of costs £82,300 to the first defendant (me) and
£18,000 to the second defendant (Twitter) by 4pm on 19 December 2013 making a
total amount due for costs of £100,300.
